Terms of Service

By creating an account or using Outlast Pool(the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a group or pool, you represent that you are authorized to accept these terms for that group.

You must be at least 18 years old and a resident of the United States to use the Service. You are responsible for ensuring that participating in a survivor pool — including any pool that involves an entry fee — is legal where you live. The Service is not available where prohibited.

Outlast Pool is a free tool for organizing and running NFL survivor pools: creating a pool, inviting players, making weekly picks, and automatically grading results. We provide software and scheduling data — nothing more.

Outlast Pool is not a sportsbook, casino, lottery, or gambling operator, and we do not facilitate betting. We are not a payment processor or escrow service.

Outlast Pool never collects, holds, transmits, or distributes any money. If a pool chooses to play for an entry fee, that money is arranged and exchanged directly between the pool’s players and its commissioner, using whatever method they choose. The Service only helps a commissioner track who has said they have paid.

We are not responsible for collecting fees, issuing refunds, resolving payment disputes, or any losses arising from money exchanged between players. You participate in any money pool at your own risk and are solely responsible for complying with all applicable laws, including tax and contest/wagering laws in your jurisdiction.

You agree to provide accurate information (including a valid email, phone number, and state of residence) and to keep it current. You are responsible for activity under your account and for keeping your password secure. Notify us promptly of any unauthorized use. One person, one account, unless a pool’s rules and our features expressly allow multiple entries.

Do not use the Service to break the law, infringe others’ rights, cheat or manipulate pool results, scrape or overload our systems, upload malicious code, or harass other users. We may suspend or remove accounts that do.

Outlast Pool is an independent product. We are not affiliated with, endorsed by, or sponsored by the National Football League, any NFL team, or any other league or organization. All team names, logos, and trademarks are the property of their respective owners and are used for identification only.

Schedules, scores, and odds are sourced from third parties and may be delayed, incomplete, or inaccurate. We grade picks on a best-effort basis and may correct results when data is wrong. The Service is provided “as is” and “as available,” without warranties of any kind, and we do not guarantee uninterrupted or error-free operation.

To the fullest extent permitted by law, Outlast Pool and its operators will not be liable for any indirect, incidental, or consequential damages, or for any loss of money, data, or pool standings, arising from your use of the Service. Because the Service is free, our total liability to you for any claim is limited to one hundred US dollars ($100).

You agree to indemnify and hold harmless Outlast Pool and its operators from any claims, damages, or expenses arising out of your use of the Service, your pools, money exchanged between players, or your violation of these terms or applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

We may update these terms from time to time. When we do, we will revise the “last updated” date above and, for material changes, take reasonable steps to notify you. Continued use of the Service after a change means you accept the updated terms.
